Terms of Service

Last updated: October 8, 2026 · Operated by Shecommerce

These Terms of Service ("Terms") govern your use of Xomily (the "Service"), including our website, mobile apps and API. By creating an account or using the Service you agree to these Terms, our Acceptable Use Policy and our Privacy Policy.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) to create an account. By registering you confirm that you meet this requirement. Businesses using the Service confirm the user has authority to bind the business.

2. Your account

You are responsible for keeping your login credentials and API tokens secure and for all activity under your account. Tell us immediately at hello@xomily.com if you suspect unauthorised use.

3. The Service

Xomily uses third-party artificial-intelligence models to generate videos, images and voice audio ("Outputs") from text you write and images you upload ("Inputs"). AI Outputs can be unpredictable, may contain inaccuracies or artefacts, and may resemble existing works or people by coincidence. You are responsible for reviewing Outputs before you use them.

4. Tokens and payments

  • Creations are paid for with tokens. Token prices and the token cost of each creation are shown before you create and may change over time; changes never affect tokens you already own.
  • Tokens have no cash value, are non-transferable and cannot be exchanged for money, except where required by law. Purchased tokens do not expire while your account is active.
  • If a creation fails or is blocked by our automated safety review, the tokens for that creation are returned automatically.
  • Payments are processed by Stripe. See our Refund Policy.
  • Promotional and bonus tokens may expire or be withdrawn if obtained through abuse (e.g. multiple accounts or self-referrals).

5. Your content and rights

Inputs. You keep ownership of your Inputs. You confirm that you own or have all necessary rights, licences and consents for every Input — including the written consent of every identifiable person in any photo you upload (and of a parent or guardian for anyone under 18) — and that your Inputs do not infringe anyone's copyright, trademark, privacy or publicity rights.

Outputs. As between you and us, and to the extent permitted by law and our model providers' terms, you own the Outputs you create and may use them for personal and commercial purposes, subject to these Terms and our Acceptable Use Policy. Because AI models can produce similar results for similar requests, Outputs may not be unique and others may create similar content.

Licence to us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit and display your Inputs and Outputs solely to operate, secure and improve the Service, to comply with law, and — only if you choose to make a creation public — to display it on share links and, if we feature it, in our gallery. You can withdraw public sharing at any time.

6. Acceptable use and AI disclosure

You must follow our Acceptable Use Policy. In particular, you may not create content depicting real public figures, content that sexualises anyone, or content intended to deceive people into believing it is real. When you publish Outputs, you must comply with laws and platform rules requiring disclosure of AI-generated or synthetic media.

7. Safety, moderation and enforcement

We automatically screen Inputs and Outputs and may block, remove, or refuse to process any content, and suspend or terminate accounts, at our discretion where we believe these Terms are violated or to protect people. We keep records of requests (including prompts, IP addresses and timestamps) as described in our Privacy Policy, and we report apparent child sexual exploitation material to the relevant authorities (such as NCMEC) and cooperate with lawful requests from law enforcement.

8. Intellectual property complaints

If you believe content on the Service infringes your rights or uses your likeness without consent, follow our takedown process. We terminate repeat infringers.

9. Third-party services

The Service relies on third-party providers (for example AI model hosts, voice providers, and payment processors). Their availability is outside our control, and features may change if a provider changes or discontinues a model.

10. Disclaimers

The Service and Outputs are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that Outputs will be accurate, unique, or suitable for your purpose.

11. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

12. Indemnity

You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your Inputs, your use of Outputs, or your breach of these Terms or of any law or third-party right.

13. Termination

You may delete your account at any time from your account settings. We may suspend or terminate accounts that violate these Terms. On termination for violation, unused tokens are forfeited to the extent permitted by law.

14. Changes

We may update these Terms. If changes are material, we'll notify you by email or in the app before they take effect. Continued use after changes take effect means you accept them.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which Shecommerce is established, without regard to conflict-of-law rules, and subject to any mandatory consumer protections in your country of residence.
